Kingsley Hayes comments on the data breach class action against Ticketmaster

MLex published an article reporting on recent developments in the data breach group action claim against Ticketmaster.

Kingsley Hayes, Head of Data Breach, commented:

“The Ticketmaster case has been the subject of a Case Management hearing before HHJ Pearce on 18 to 19 October 2021 where the Court and Parties agreed for test cases to take place over a 5 week period in or around November 2022.

The Court also heard an application for a summary Judgment and strike out of the Misuse of Private Information claim following the High Court hearing in the case of Warren v DSG. The Defendant was unsuccessful in that application and the Court agreed that this case had features that led to triable issues on Misuse. This aspect of the claim, as well as the claim more generally moves to trial next year.

This was a significant victory for the Claimants in light of the issues created by Warren.”
